REGULATIONS FOR THE ORGANIZATION OF THE NATIONAL CHAMPIONSHIP OF ZACUSCA

Art. 1 – The organizer of the NATIONAL SATURDAY CHAMPIONSHIP is SC GASTROART SERVICES SRL  with registered office in  Nucsoara Street, no. 6, bl. 42, stair F, floor 1, apartment 84, room 2, Sector 6, Bucharest registered in the Trade Register under no. J40/6173/11.06.2020, CUI: 42612544, Account: RO54BTRLRONCRT0554783201, opened at Banca Transilvania, Sucursala Mihai Bravu, represented by Dragomir Cosmin Laurentiu as administrator, hereinafter referred to as provider, in collaboration with the National Federation of Authorized Tasters, which will also grant the scientific patronage of the CHAMPIONSHIP and the contributory support of other national organizations or bodies, but also with the support of sponsors, will do everything possible to highlight the quality of products made by farmers, private producers, companies and other industries in the field.

Art. 2 – THE PURPOSE, THE “NATIONAL CHAMPIONSHIP OF ZACUSCA” is that of:

  • to highlight the culture that led us for so long to obtain the dishes present in the competition.
  • the diversity of types of sausages existing in the country.
  • promoting and encouraging the obtaining of these preparations with a longer shelf life
  • highlighting dishes with special qualities, awarding and promoting them.
  • make consumers aware of the characteristics of these preparations, of what they must look for on the labels they purchase, of choosing correctly processed preparations that use quality ingredients, a technology that is as minimally invasive as possible and to choose informed from the very complex existing offers on market.
  • supporting local governments with a strong vocation in the production of these foods, as they have an important role in supporting the development of the local economy.

Art. 3 – PARTICIPATION REQUIREMENTS

Samples from all over the country will be accepted subject to the following conditions:

the manufacturer to be legally authorized

be listed in at least one store

to be labeled in accordance with legal requirements

the manufacturer to complete Annex 1 to this regulation, by which he confirms the existence on the market of a number of pieces from the lot presented in the competition.

The sausage CHAMPIONSHIP provides for a minimum of 3 samples, of which a minimum of 2 (two) will be opened by the judges for evaluation.

Art. 4 – CLASSIFICATION OF EVIDENCE

THE NATIONAL CHAMPIONSHIP OF ZACUSCA has as its main purpose the verification and classification of the samples entered in the competition. Rigorous measures will be adopted for the receipt of evidence, its classification, secrecy, opening and presentation to the appointed commissions for judging.

Since the ZACUSC NATIONAL CHAMPIONSHIP is not under the auspices of similar international competitions and is not registered or affiliated with any international forums, the organizer reserves the right to make changes during the CHAMPIONSHIP, changes that will not interfere with the decisions of the jury committees and will not raises suspicions about the awarding of prizes and medals.

Art. 5 – THE ORGANIZING COMMITTEE,

will consist of:

The members of the National Federation of Authorized Tasters, who will be nominated by its management until 01.03.2024 both for the reception and storage of samples, as well as for the judging committees, but also (other) specialists in the HoReCa field: chefs, sommeliers, culinary bloggers and journalists, etc

Members designated for the reception, storage, classification and secrecy of evidence CANNOT BE NOMINATED IN THE JURY COMMITTEES.

The Organizing Committee has the essential task of supervising the implementation of the initiative, compliance with the regulations, coordination of the registration of the evidence, their secrecy, presentation of the evidence to the judging committees, withdrawal and storage of the evidence in a specially arranged space for declassification at the end of the CHAMPIONSHIP.

Also, the Organizing Committee will take care of maintaining order in the jury room as well as outside it in order not to disturb the commissions or the jurors in any way.

Art. 6

TECHNICAL SCIENTIFIC COMMITTEE

The Scientific Technical Committee is chaired by: (here it will be about those who will decide which are the characteristics that will be judged and based on which the points will be awarded)

Art. 7 – METHOD OF REGISTRATION

Companies that intend to participate in the "NATIONAL CHAMPIONSHIP OF ZACUSCĂ", can participate in the following way:

Paying the participation fee/ per sample, following the registration procedure by completing the form (ANNEX 1) ON-LINE on cosmindragomir.ro and the subsequent instructions. Invoicing is done on the basis of a contract.

The deadline for receiving samples and product presentation sheets at the address: Winemotion SRL, splaiul unirii no. 993-999, postal code 030140, Bucharest (Maria – 0762056031) ends on March 29, 2024, 5 p.m.

entering the Competition obliges the Company to pay the fee and send the samples within the established deadlines.

no refunds are made in case of non-delivery of samples or delay in their delivery.

payments related to the registered samples must be made by the date of their delivery, provided by the regulation in force.

unpaid samples at the time of the CHAMPIONSHIP will NOT be tasted.

if a company already has debts to the organizing body for non-payment of samples from previous editions, it will not be able to register for the new edition of the competition unless it has paid its debt in full.

The following documents are required for each sample (which can also be included in the package with which the shipment is made):

DOP, GI, etc. quality certificate issued by the control structure in the production area, or, for Self-certification, a production report of the company manager, with his original signature.

The participating company undertakes to allow access to the production premises, to any person sent by the Organizing Committee, to take samples in case of suspicion.

A number of 3 jars of zacusca / type of zacusca will be sent, with the specification:

"Tests for competition exempted from payment of legal fees".

The responsible official organizer reserves the right to carry out its own comparative and control analyses, within a period of 12 months after the CHAMPIONSHIP has been held, in the event that the number of medals requested exceeds the number of jars in the staggered batch when registering the tests

Art. 8 – RESPONSIBILITY

The organizers disclaim any responsibility for any delay in the delivery of the samples compared to the set date, for the total or partial loss of the samples during transport, as well as for the state of preservation of the samples themselves. All costs related to the delivery of the samples are fully borne by the participating companies.

Art. 9 – RECEIPT OF EVIDENCE

The official authorized organizer checks the packaging of the products received and the official documentation that accompanies them. From the moment of receipt, all samples participating in the NATIONAL CHAMPIONSHIP of ZACUSCĂ will be preserved according to the rules of good practices and techniques.

The organizer reserves the right to commercially purchase samples for evaluation

The samples, before being examined by the commissions, will be classified by using two specific codes:

The first code assigned to the sample by the staff of the official authorized body at the time of its receipt.

The second code, assigned by the officially appointed committee, will be decided before the evidence is presented to the judging committees.

Art. 10 – EVALUATION

The evaluation of the samples will be carried out in the first half of 2024 by expert tasters, sommeliers and journalists with proven experience in the food sector.

Each commission consists of five jurors. In no case may the number of jurors be less than five. Judges are mostly members of the FNDA, but not necessarily.

The tasting commissions will evaluate the samples according to the regulations that they will establish by mutual agreement with the Main Organizer and that will be communicated one week before the competition, both to the producers and to the public opinion, journalists and mass media in general.

The evaluations will be expressed independently by each member and the final score will be obtained based on the arithmetic mean of the individual evaluations.

The results of the evaluation operations will be published as soon as possible on the cosmindragomir.ro website

Art. 11 – CONFIDENTIALITY

In order to protect the prestige of the participating companies, the authorized official body will only make known the list of awarded products and the names of the related companies.

Art. 12 – RECOGNITIONS AND AWARDS

Based on the score obtained and what is determined by the sensory analysis of the samples, according to the regulations of this contest, all products that exceed a certain number of points will be awarded with the awarding, for each product category, of the following general distinctions:

Great Gold Medal (Score over 95/100)

Gold Medal (Score over 90/100)

Silver medal (Score over 85/100)

and will be recognized, with the distinction mentioned above, the "National Zacuscă CHAMPIONSHIP".

Publishing the company name and related award-winning products on the website cosmindragomir.ro as well as in the related press release.

Press media service on the occasion of the awards ceremony to communicate both the results and all other initiatives related to the Competition.

Preparation and printing of SELF-ADHESIVE STICKERS for CERTIFICATION of AWARDED PRIZES.

Technical assistance and organizational support for the presentation of winning products at promotional events.

No reproduction related to the Zacuscă CHAMPIONSHIP is authorized nor can it be placed on the bottles of the winning product, except for the sticker described above, which can be purchased from SC GASTROART SERVICII srl.

Winners can communicate the prizes obtained in social media, but they are not allowed to mark the recognition obtained in the contest on jars/cans/containers without the organizer's consent and insignia.

Art. 13 – CONTROLS

The winners of the NATIONAL CHAMPIONSHIP of ZACUSCA will have to allow the officially authorized, or delegates to take any sample necessary to rule out any doubt about the correctness of the manufacturer.

If they have not fully complied with the Regulations, they will lose any recognition granted (at the time of the award ceremony) and the Committee itself will draw up minutes and make a public announcement to the national media.

Art. 14 – DISPUTES.

Force majeure clause

14.1. None of the contracting parties is responsible for non-execution on time and/or improper execution - total or partial - of any obligation that falls to it, based on this contract, if the non-execution or improper execution of the respective obligation was caused by force majeure , as defined by law.

14.2. The party invoking force majeure is obliged to notify the other party within 3 (three) days from

occurrence of the event and to take all possible measures in order to limit its consequences. 14.3. If within 5 (five) days from the occurrence, the respective event does not cease, the interested party has the right to notify the termination, by right, of this contract, without claiming damages.

Art. 15. Notification between the parties

15.1. In case of non-payment on time of the consideration (price) of the services provided, the notification will be sent in writing, after 10 days from the deadline stipulated in the contract. If the payment deadline stipulated in the notification is not respected, this leads to the suspension of the execution of the works until the recovery of the outstanding amounts.

15.2. In the agreement of the contracting parties, the communications are validly fulfilled if they will be sent by email to the electronic addresses specified in this paragraph or in any way that ensures good reception of these

communications

15.3. If the communication is made by post at the offices of the Parties, it is considered received by the addressee

on the date mentioned by the receiving post office, on the envelope or confirmation.

15.4. If the notification is made by fax or email, it is considered received on the first working day after it was sent.

Art. 17. Litigation

If it is not possible to resolve the misunderstandings amicably, they will be submitted for resolution to the competent courts within the radius of the City of Bucharest.

Art 18. PROTECTION OF PERSONAL DATA

18.1. With regard to the processing of personal data, the parties agree that it is possible that in the performance of this Agreement, certain personal data may be disclosed or incidentally have access to personal data in the performance of its obligations under the Agreement. In this case, each party declares and undertakes to comply with the following:

all personal data received/acquired from the other party (including, but not limited to, those mentioned in the Contract and/or any additional documents to the Contract) will be processed in accordance with data protection legislation, including GDPR provisions;

all personal data received/acquired will be processed exclusively for the purpose of executing and administering this Agreement, except in situations where the transmission of this data is requested by the competent bodies and/or institutions, including by the Supervisory Authority ( ANSDPCP). In this case, a written notification is sent to the other party, within 2 working days, regarding the respective request, unless such notification is prohibited for reasons related to the public interest;

notification of any personal data security breach involving his personal data;

ensuring respect for any of the data subject's rights, namely: the right of access, the right of rectification, the right to restrict processing, the right to deletion ("the right to be forgotten"), the right to data portability, the right to oppose processing or the right to not to be subject to an automated individual decision;

will inform the persons concerned about and obtain their consent in accordance with and in compliance with the GDPR for the transmission of Personal Data to third parties

Art. 19 Termination of the contract

This Contract terminates in the following cases:

a) by the written agreement of the parties expressed before the expiration of the duration provided in the contract;

b) upon expiry of the contractual term

c) by termination, in the event of non-fulfilment or improper fulfillment of the obligations by one of the contracting parties.
